Financial Disclaimer & Risk Disclosure

Read this document before using MCFX Terminal. By accessing any feature of the platform you accept these terms.

01

No Financial Advice

MCFX Terminal (the "Platform") is analytical software operated by MCFX Technologies Inc.. Everything the Platform publishes, including macro driver scores, COT positioning reads, pair-level percentiles, confluence grades, thesis output, playbook entries, seasonality context and any written, visual or automatically generated commentary, is provided strictly for informational and educational purposes.

Nothing on the Platform is financial advice, investment advice, trading advice, or a recommendation to buy, sell or hold any currency, instrument or derivative. MCFX Technologies Inc. is not a financial advisor, portfolio manager, registered dealer, introducing broker or any other regulated financial entity, and does not hold client funds.

The Platform is not a substitute for professional financial, legal or tax advice. Consult a licensed professional in your own jurisdiction before making any trading or investment decision.

02

No Guarantees of Results

Past behaviour of any framework, score, signal or directional bias produced by the Platform does not predict future results. Trading foreign exchange involves substantial risk of loss and is not suitable for everyone.

Any reference to accuracy rates, hit rates, historical performance, backtests, expectancy, conviction scores or track record is illustrative of the methodology only. It is not a representation of what you will achieve. You may lose some or all of your capital.

No performance promise

MCFX Technologies Inc. makes no representation that use of the Platform will produce profitable trades, a passed prop firm evaluation, account growth, or any other financial outcome. No refund, credit or remedy offered by MCFX Technologies Inc. is conditioned on, or offered in respect of, your trading results.

03

Decision Support, Not Decisions

MCFX Terminal is a decision-support tool. It organises institutional positioning data published by the U.S. CFTC through the Commitments of Traders report, macroeconomic rate and policy data, and technical context, and presents them in one place so that a trader can form a view faster.

It does not form the view for you. The Platform's grades and reads are structured opinions about context, not instructions. You are solely responsible for every position you open, size, hold and close, and for the risk management applied to it.

Important risk warning

Foreign exchange trading carries a high level of risk and may not be suitable for all investors. The leverage available in FX works against you as readily as for you. Before trading, consider your objectives, your experience and your risk appetite, and never risk capital you cannot afford to lose.

04

Market Risk Acknowledgment

By using the Platform you acknowledge that:

  • AMarkets are not predictable and no analytical system can guarantee directional accuracy.
  • BCOT data is published on a lag. It reports positions as of Tuesday and is released the following Friday, and it is delayed further around U.S. holidays. It is a snapshot of the past, not of the present.
  • CCentral bank decisions, data surprises, geopolitical events and liquidity shocks can invalidate any output on the Platform instantly and without notice.
  • DScores, grades and biases are probabilistic assessments. A high grade describes agreement between inputs, not certainty about an outcome.
  • EEvent warnings shown by the Platform are informational. They do not prevent you from trading and are not a determination that a trade is safe or unsafe.

05

Automated Execution

Where the Platform offers, or is connected to, any automated component that routes orders to a broker or trading platform, including an expert advisor, bridge, script or API integration, that component executes instructions you configure. It does not exercise judgment on your behalf.

You remain responsible for your broker account, your credentials, your position sizing, your risk limits, and for monitoring any automation while it is running. MCFX Technologies Inc. does not have custody of your funds and cannot reverse, cancel or amend an order once your broker has accepted it.

Automation risk

Automated execution introduces failure modes that manual trading does not have: connectivity loss, broker rejection, latency, slippage, duplicated or missed orders, incorrect symbol mapping, and misconfiguration. MCFX Technologies Inc. is not liable for losses arising from any of these, including losses that occur while automation runs unattended. Test any automation on a demo account before using it with capital.

06

AI-Generated Analysis

Parts of the Platform's written output, including narrative market briefs, thesis summaries and explanatory text, are generated with the assistance of large language models. This content is produced automatically from the underlying data and is not individually reviewed before it is displayed.

AI-generated text can be incomplete, out of date, or wrong. It may state a relationship the data does not support. Treat it as a summary to verify against the underlying figures shown alongside it, not as an authority. Where narrative text and the underlying data disagree, the data governs.

AI-generated content is never personalised advice, and is not tailored to your account, your risk tolerance or your circumstances.

07

Data Sources

The Platform derives its analysis from the following upstream sources:

  • U.S. Commodity Futures Trading Commission (CFTC) Commitments of Traders
  • FXMacroData
  • Federal Reserve Economic Data (FRED)
  • Central bank publications, including the Bank of Canada, Swiss National Bank, Bank of England and Bank of Japan

These providers are independent of MCFX Technologies Inc.. They set their own terms of use, revision policies and publication schedules, and they may restate, delay or withdraw data without notice to us. Naming a source here is not a claim of endorsement or partnership beyond the licence or public access under which we obtain the data.

08

Accuracy & Latency

MCFX Technologies Inc. makes reasonable efforts to ingest, validate and display data correctly, but gives no warranty, express or implied, as to the completeness, accuracy, timeliness or availability of anything shown on the Platform.

The Platform can be affected by upstream revisions, feed interruptions, ingestion failures, stale caches and calculation errors. Where a value cannot be computed the Platform is designed to show that it is unavailable rather than to substitute an estimate, but this behaviour is not guaranteed in every case.

MCFX Technologies Inc. is not liable for trading losses arising from reliance on data that was inaccurate, delayed, revised or unavailable.

09

Third-Party Services

The Platform integrates with, references and links to third-party providers, brokers, tools and websites. MCFX Technologies Inc. does not control them and is not responsible for their content, accuracy, security or business practices. A link or integration is not an endorsement.

Your relationship with any broker, prop firm or payment provider is governed by your agreement with them, not by this document.

10

Unauthorised reproduction, distribution, modification, commercial use, reverse engineering, scraping or republication of Platform content, in whole or in part, without prior written consent is prohibited.

The Platform is not a registered financial service. It is not registered with, authorised by or endorsed by any financial regulatory authority, including the Ontario Securities Commission, CIRO, the FCA, the CFTC, the SEC or any equivalent body in any other country.

The Platform is offered internationally. You are responsible for determining whether your use of it is lawful where you are, and for complying with the financial, tax and reporting rules that apply to you. If access to this type of service is restricted in your jurisdiction, do not use the Platform.

12

Limitation of Liability

To the maximum extent permitted by applicable law, MCFX Technologies Inc., its directors, officers, employees, contractors and affiliates are not liable for any direct, indirect, incidental, consequential, special or exemplary damages arising from your use of, or inability to use, the Platform. This includes trading losses, lost profits, lost opportunity, loss of data and business interruption.

Nothing in this document limits liability that cannot be limited under applicable law, including liability for fraud.

Your sole remedy for dissatisfaction with the Platform is to stop using it.

13

Updates to This Disclaimer
